What is the ESIC 10-Day Rule?
The ESIC 10-day rule means employers must register new employees on the ESIC portal within 10 days of their start date if their monthly wages are ₹21,000 or less (₹25,000 for employees with disabilities). This applies to factories or establishments with 10 or more employees (20 in some states). Registration ensures workers get access to medical care, maternity benefits, and financial support during sickness or disability.
Who Needs to ESIC Registration 2025?
Employers must register employees who:
- Earn up to ₹21,000 per month (or ₹25,000 for persons with disabilities).
- Work in non-seasonal factories or establishments covered by the ESI Act.
- Are new hires or existing employees not yet registered.
Steps to Register Employees
Here’s how employers can register employees within 10 days:
- Log in to the ESIC Employer Portal at www.esic.gov.in using your establishment’s login credentials.
- Go to “Employee” and select “Register New Employee.”
- Enter the employee’s details: name, Aadhaar number, date of birth, joining date, and monthly wages.
- Upload a scanned copy of the employee’s Aadhaar card and bank details.
- Submit the form to generate an Insurance Number for the employee.
- Verify details and ensure the employee’s Aadhaar is linked to their mobile number for OTP validation.
- Complete registration within 10 days from the employee’s joining date (e.g., if hired on 1st April 2025, register by 10th April 2025).
Important Dates and Compliance
- Registration Deadline: Within 10 days of an employee’s joining date.
- Contribution Periods: April–September (returns due 11th October 2025) and October–March (due 11th April 2026).
- Contribution Payments: Due by the 15th of the next month (e.g., April 2025 contributions due by 15th May 2025).
Contributions are 0.75% of wages (employee) and 3.25% (employer).
Penalties for Non-Compliance
Failing to register employees within 10 days can lead to:
- Interest at 12% per year for delayed contributions.
- Fines up to ₹10,000 or imprisonment up to three years under the ESI Act.
