Virginia SNAP Food Ban 2026: Virginia’s SNAP restriction on carbonated sweetened beverages starts November 1, 2026 after two delays. See what is banned, what is allowed, the court ruling’s impact, deposit dates and official VDSS links.
Virginia’s SNAP “sweetened beverage” restriction has been delayed twice. It was first set for April 1, 2026, then moved to October 1, and is now scheduled to begin November 1, 2026. Starting November 1, SNAP customers in Virginia will no longer be able to buy carbonated sweetened drinks with SNAP benefits. Your eligibility and benefit amount do not change.

Timeline: How the Date Moved?
| Date | Event |

| Dec 10, 2025 | USDA approves the project to exclude “sweetened beverages,” for two years, effective April 1, 2026 |
| Feb 3, 2026 | Virginia asks to move the start to October 1, 2026 |
| Feb 25, 2026 | USDA approves the October 1 date |
| Mar 31, 2026 | VDSS confirms the April 1 start was delayed to October 2026 |
| June 22, 2026 | Federal court vacates waivers in five other states |
| Sept 15, 2026 | USDA posts a request for public comments on Virginia’s project |
| Oct 1, 2026 | Local news reports VDSS announcing the November 1 start |
| Nov 1, 2026 | Restriction begins |
Grocery Dive reported that the state’s website now says the waiver takes effect on November 1. In the sources I reviewed, VDSS did not publish one single stated reason for the second delay. It came as USDA began publishing Federal Register notices and taking public comments before waiver starts in several states.
What Is Restricted? (Official VDSS List)
VDSS says SNAP benefits cannot be used to buy soda, diet soda, “zero” or artificially sweetened soda, carbonated energy drinks, or carbonated drinks with 5 grams of added sugar or more per serving. Probiotic or “better-for-you” sodas are also classed as sodas, but milk- or yogurt-based probiotic drinks remain eligible.
The key rule is simple: carbonated and sweetened. Only carbonated beverages with added sweeteners are affected.
What Is Still Allowed?
VDSS lists these as still SNAP-eligible: lemonade, iced tea, iced coffee, juice and juice drinks, milk and plant-based milks including chocolate milk, unsweetened seltzer or sparkling water, non-carbonated “fizz-free” energy drinks, sports or hydration drinks, kombucha, yogurt drinks, infant formula, and nutritional or meal replacement drinks.
There is no change to which foods you can buy with SNAP.

Why Is SNAP Enrollment Falling in 2026? Key Reasons Behind the Decline in SNAP Participation
How It Works at the Store?
- Restricted drinks will not go through on SNAP, just like alcohol or paper goods, and you can pay for them with another payment method.
- You may buy any beverage with non-SNAP funds, including in the same transaction.
- The rule applies to online purchases, and retailers, not third-party platforms, are responsible for compliance.
- It applies at Virginia retailers regardless of which state issued the EBT card.
- It does not apply to Virginia Restaurant Meals Program restaurants.
- If a restricted item goes through by mistake, the retailer is responsible and customers will not get in trouble.
You do not need to complete any paperwork before November 1.
Retailer Obligations
All SNAP-authorized retailers in Virginia must make the update beginning November 1, and they are responsible for updating point-of-sale systems and training staff. VDSS provides definitions, guidance documents, printable signs and a list of commonly affected beverages with UPC codes. Unresolved noncompliance may be referred to USDA and could affect a retailer’s authorization to accept SNAP.
Federal Court Ruling: What It Means for Virginia?
On June 22, 2026, the U.S. District Court for the District of Columbia, in Aragon et al. v. Rollins et al., vacated USDA’s waiver approvals for Colorado, Iowa, Nebraska, Tennessee and West Virginia. Virginia was not one of the five states in that case, so the ruling did not directly cancel Virginia’s waiver.
What followed?
- The court also found that USDA failed to meet its own requirement to publish notice in the Federal Register at least 30 days before such projects begin.
- USDA then posted a request for public comments on Virginia’s demonstration project.
- USDA appealed the district court decision in late August 2026, and the parties had not yet briefed the issues at that time.
- USDA’s Virginia waiver page has a “Notice of Approval” link, while its status text still mentions the earlier October 1 date. Treat the November 1 date on USDA’s summary table and on VDSS as current.
The legal question is not fully settled, so the status of any waiver could change if a court rules on the appeal or a new challenge is filed.
Payment Details for Virginia SNAP Households
Deposit Schedule
Virginia’s issuance schedule has three dates based on the last digit of your case number (not your EBT card number), and benefits are added at 12:01 AM on the date, even if it falls on a weekend or holiday.
| Case Number Ends In | Deposit Day | November 2026 | December 2026 |
| 0, 1, 2, 3 | 1st | Sunday, Nov 1 | Tuesday, Dec 1 |
| 4, 5 | 4th | Wednesday, Nov 4 | Friday, Dec 4 |
| 6, 7, 8, 9 | 7th | Saturday, Nov 7 | Monday, Dec 7 |
VDSS states that the monthly benefit amount and benefit schedule are not changing.
Maximum Benefits (October 2026 to September 2027)
VDSS lists these maximum allotments: $306 for one person, $562 for two, $808 for three, $1,023 for four, $1,217 for five, $1,463 for six, $1,616 for seven and $1,841 for eight. These are maximums, and your actual benefit depends on income and deductions.
Income Limits
VDSS lists gross monthly income limits of $1,729 for one person and $3,575 for four people under standard rules, and $2,660 and $5,500 under broad-based categorical eligibility (200% of poverty).
New Chip EBT Cards
Virginia began issuing chip-enabled SNAP EBT cards in September 2026, and all customers will receive a new card by December 31, 2026. Key points:
- Your old magnetic-stripe card stops working when you activate the new chip card, or 60 days after the new card is mailed.
- You tap or insert the card instead of swiping.
- You set a new PIN each time a new card is issued.
- Keep your address, phone and email up to date so the card reaches you.
- VDSS recommends setting up a ConnectEBT account and keeping your current card until the new one arrives.
Change for VaCAP Customers
VaCAP ended effective June 1, 2026, and those cases move to the Elderly Simplified Application Project at the next recertification, after which the SNAP allotment is based on income and allowable expenses and is no longer a fixed amount.
Funding Status
A continuing resolution signed September 2, 2026 provides FY2027 funding through December 11, 2026. November and early December issuances fall within that window. Check VDSS notices if Congress has not acted by December 11.
If You Have a Problem
- Payment questions: check your balance in ConnectEBT or call the EBT Help Desk at 1-866-281-2448.
- Restriction questions: email SNAPHealthy@dss.virginia.gov.
- Card issues: contact your local department of social services.
- Double charge: speak with the store manager first, then call the EBT Help Desk to file a claim, which is usually resolved within 10 business days.
- Scams: never share your PIN, and lock your card in ConnectEBT when not in use.
Outdated Claims to Avoid
- Saying the restriction began October 1, 2026 or April 1, 2026.
- Saying diet or zero-sugar soda is allowed in Virginia. It is restricted.
- Saying candy is banned in Virginia. The restriction covers beverages only.
- Saying the court blocked Virginia’s waiver. The June ruling covered five other states.
- Saying your payment amount or deposit date changes. VDSS says neither changes.

Conclusion
Virginia’s SNAP beverage restriction begins November 1, 2026, after two delays, and it targets carbonated sweetened drinks, including diet and zero-sugar soda. Your benefit amount and deposit date do not change, and the new chip EBT card is arriving this fall. The legal picture around state waivers is still moving, so confirm the latest on VDSS and USDA before relying on any date.
